HERO GROUP PRIVACY POLICY

This Privacy Policy describes how Hero Group LLC (“Hero Group,” “we,” “our,” “us”) collects, uses, shares, stores, and protects information in connection with our websites, tools, analytics systems, and AI-powered services, including the Financial Analysis Machine (“FAM”).
By accessing or using any Hero Group service, you agree to this Privacy Policy.
- Information We Collect
Hero Group collects information in the following categories:
1.1 Information You Provide
This includes business and operational data such as:
- repairable ROs, total losses, car count
- labor rates, parts mix, revenue/expense categories
- staffing counts and productivity metrics
- cycle time data and throughput metrics
- financial assumptions and owner priorities
- severity mix, blueprinting processes, and operational workflows
FAM is not designed to accept personal information (PII).
You should avoid entering customer names, VINs, employee identifiers, or other direct identifiers.
If you choose to submit PII, you are solely responsible for ensuring lawful authority to do so.
1.2 Automatically Collected Information
We may automatically collect:
- IP address and device identifiers
- browser, OS, and device type
- interaction logs and usage behavior
- feature usage (including FAM workflows)
- session duration, click paths, and page analytics
- error messages and diagnostic logs
- performance data and system telemetry
1.3 Cookies and Tracking Technologies
We use cookies and similar technologies for:
- essential site functionality
- authentication and security
- analytics and performance monitoring
- usage understanding and product improvement
You may disable cookies in your browser, though some features may not function correctly.
1.4 Data from Co-Branded Partners
If you access FAM through a co-branded page:
- Hero Group may receive referral analytics, aggregate usage, or metadata.
- Partners do not receive your business inputs or Report results unless you explicitly provide such data outside of FAM.
1.5 Information Collected Through QuickBooks or Third-Party Accounting Integrations
If you choose to connect the Service to QuickBooks Online (“QuickBooks”) or another third-party accounting system, Hero Group may automatically collect accounting-related data (“Accounting Data”), including revenue data, expense data, chart-of-accounts structure, vendor transactions, classifications, financial statements, and other accounting-related information necessary to operate the Service.
Accounting Data is treated as User Data under this Policy.
- How We Use Information
Hero Group uses collected information for:
2.1 Operating the Service
Including:
- generating Reports
- processing User Data using AI
- loading, saving, and formatting data
- running benchmarks and projections
2.2 Securing, Maintaining, and Troubleshooting
We process information to:
- maintain site stability and uptime
- detect bugs, crashes, or security issues
- support debugging and infrastructure monitoring
- protect against unauthorized access
2.3 Improving Products and Developing New Tools
Hero Group may transform User Data into anonymized, aggregated, de-identified, or statistically transformed data (“Derived Data”).
Hero Group may use Derived Data:
- to train and improve AI models
- to develop, enhance, or commercialize tools
- for analytics, benchmarking, and insights
- for internal research
- across the broader Hero Group ecosystem
- for any lawful commercial or product development purpose
Derived Data cannot reasonably identify you or your business.
You agree Hero Group may retain and use Derived Data indefinitely and without restriction.
2.4 Communications
We may use collected information to:
- respond to inquiries
- provide updates and notices
- send optional marketing communications (opt-out available)
2.5 Legal Compliance
We may process or retain information to comply with:
- laws and regulations
- requests from authorities
- auditing and legal recordkeeping obligations
2.6 Use of Information from QuickBooks or Accounting Integrations
Hero Group uses Accounting Data to:
- generate Reports and financial analyses;
- run benchmarks, projections, and modeling;
- maintain and improve the Service;
- develop new analytics, tools, and features;
- train AI models using Derived Data;
- support troubleshooting and diagnostics.
Hero Group does not modify or post data into your QuickBooks account.
- How We Share Information
Hero Group may share information as follows:
3.1 Service Providers
We use trusted subprocessors for:
- hosting and storage
- infrastructure management
- analytics and diagnostics
- AI model execution
- PDF generation and reporting
- service providers supporting third-party integrations such as QuickBooks data synchronization
They must maintain confidentiality and appropriate security measures.
3.2 Co-Branded Partners
Partners may receive:
- non-identifying traffic metrics
- referral analytics
- aggregate usage totals
Partners do not receive your identifiable business inputs or Report data unless explicitly authorized by you.
3.3 Legal and Safety Requirements
We may disclose information:
- to comply with applicable laws
- to respond to legal or governmental requests
- to protect the rights, safety, or security of Hero Group, users, or others
3.4 Business Transfers
In the event of a merger, acquisition, restructuring, financing, or sale of assets, information may be transferred to the successor entity.
Derived Data may be included as part of transferred assets.
3.5 QuickBooks and Accounting Integrations
Hero Group does not share your Accounting Data with QuickBooks or Intuit beyond what is required to maintain the connection you authorize.
Hero Group is not responsible for the data-handling practices, errors, outages, or security of QuickBooks or any third-party accounting platform.
- User Data, Ownership, and Derived Data
4.1 User Data
You retain ownership of the original form of all information you submit (“User Data”). Hero Group does not claim ownership of the input itself. Accounting Data retrieved from QuickBooks or any third-party integration is treated as User Data.
4.2 License to Hero Group
You grant Hero Group a perpetual, irrevocable, worldwide, royalty-free, transferable, sublicensable license to:
- collect, process, store, reproduce, modify, analyze, and transmit User Data
- operate and maintain the Service
- generate Reports
- diagnose, secure, and troubleshoot
- create and preserve Derived Data
- use User Data to train, improve, and enhance AI models and analytics systems
This license survives termination and applies as long as User Data is needed to maintain Derived Data or system integrity. This license includes Accounting Data obtained through integrations you authorize.
4.3 Derived Data
Hero Group may transform User Data into anonymized, aggregated, de-identified, or statistical datasets (“Derived Data”).
Hero Group may:
- retain Derived Data indefinitely
- use, disclose, commercialize, license, publish, sell, or otherwise exploit Derived Data for any lawful purpose
- use Derived Data in any Hero Group product, service, research initiative, or business line
You acknowledge:
- Derived Data is exclusively owned by Hero Group
- You have no ownership, intellectual property rights, or compensation rights in Derived Data
- Deletion of User Data does not require deletion of Derived Data
- Derived Data rights survive termination of your use of the Service
- Derived Data may be generated from Accounting Data, and such Derived Data will not be deleted upon request.
- Data Security
Hero Group employs commercially reasonable measures, including:
- encryption in transit and at rest
- access controls and authentication safeguards
- system logging and monitoring
- routine security assessments
No system is 100% secure. You are responsible for protecting your own devices, access credentials, and networks.
Hero Group does not control and is not responsible for the security practices of QuickBooks or any third-party accounting service. You are responsible for maintaining appropriate user permissions, access controls, and security settings in your QuickBooks account.
- Data Retention
6.1 User Data
Hero Group may retain User Data as long as necessary to:
- operate and maintain the Service
- generate Reports
- support troubleshooting and diagnostics
- maintain audit logs and fulfill legal obligations
- create or preserve Derived Data
Upon request, and where legally permissible, Hero Group may delete or anonymize User Data.
However:
- Derived Data will not be deleted, and
- Deletion of User Data does not affect Hero Group’s rights to Derived Data.
- Accounting Data is retained in the same manner as other User Data. Disconnecting QuickBooks does not delete previously synchronized Accounting Data.
6.2 Derived Data
Hero Group may retain Derived Data indefinitely and may:
- use it without restriction
- commercialize or license it
- publish or distribute it
- incorporate it into present or future AI models, analytics, or products
Derived Data is not subject to deletion or modification requests.
- International Data Transfers
All data may be stored or processed in:
- the United States (primarily Texas)
- data centers operated by subprocessors in other jurisdictions
By using Hero Group services, you consent to cross-border data transfers. This includes Accounting Data retrieved from QuickBooks or other third-party systems.
- Your Rights
You may have rights to:
- request access to your User Data
- request correction of inaccurate User Data
- request deletion of User Data (subject to Section 6)
- opt out of marketing communications

Hero Group may verify identity before responding.
- No Professional Advice; User Responsibility
All reports and outputs generated by FAM or other Hero Group tools:
- are AI-generated;
- may contain errors, assumptions, or approximations;
- are for informational purposes only;
- do not constitute financial, accounting, legal, insurance, regulatory, or professional advice.
You are solely responsible for:
- validating and interpreting outputs;
- obtaining professional advice as needed;
- decisions made based on Hero Group outputs.
Hero Group and any co-branded partner disclaim all liability arising from reliance on the Service. You are solely responsible for the accuracy and completeness of any Accounting Data synchronized from QuickBooks. Hero Group does not audit, validate, reconcile, or verify accounting records imported into the Service.
- Changes to This Policy
Hero Group may update this Privacy Policy at any time. The “Last Updated” date will reflect the most recent revision. Continued use of the Service constitutes acceptance of the changes.
- Governing Law and Dispute Resolution
This Privacy Policy is governed exclusively by the laws of the State of Texas.
Any dispute arising out of or relating to this Policy or Hero Group services shall be resolved exclusively by binding arbitration in Austin, Texas, administered by the American Arbitration Association (AAA) or another agreed arbitration provider.

- Class Action Waiver: All claims must be brought individually.
Either party may seek injunctive relief in Texas courts to protect intellectual property or enforce arbitration awards.
You consent to personal jurisdiction in Texas.
